Plain language. Binding terms.

1. What FAR is

   FAR Action Radar publishes the live output of an experimental algorithmic model that produces gold-market direction calls. The Service includes:

   • Live algorithmic outputs (direction, confidence, computed reference levels)
   • A retrospective track record of past algorithm outputs with hit/miss outcomes
   • Educational context about the algorithm's methodology

   FAR is operated as an independent, non-commercial research project, for educational and research purposes.

   The operator is not a licensed investment adviser, broker, dealer, fund manager, financial planner, or registered representative in any jurisdiction.

   The Service is not available to users in certain jurisdictions. Where access is restricted, users will see a notice in place of the Service. Restrictions may change over time without prior notice.

2. What FAR is not

   FAR is not, and does not provide:

   • Investment advice, financial advice, tax advice, or legal advice
   • A recommendation to buy, sell, or hold any financial instrument
   • Personalized guidance based on your situation, risk tolerance, capital, or objectives
   • A signal service, trading service, or copy-trading platform
   • A brokerage, exchange, execution venue, or custody platform
   • A guarantee of profits, outcomes, accuracy, or future performance
   • A regulated financial service, brokerage, or licensed advisory product

   The algorithm’s outputs are computational predictions, not recommendations. The algorithm has no knowledge of you, your account, your situation, or your objectives. It has no awareness of who is reading the Service.

   Past algorithm performance does not predict future results. Algorithm outputs may be wrong. Hit rates shown reflect past resolved outputs only and are not indicative of future accuracy.

3. Use at your own risk

   The Service is provided for general informational, educational, and research purposes only. Nothing on the Service is directed at you or any individual user.

   You alone are responsible for:

   • Your own investment, trading, and financial decisions
   • Independently verifying any information before acting on it
   • Consulting a licensed professional if you need personalized advice
   • Managing your own risk, position sizing, and execution
   • Understanding the financial instruments you trade

   Trading financial instruments involves substantial risk of loss, including the possibility that you lose more than the capital you commit. Leverage amplifies both gains and losses. Do not trade with capital you cannot afford to lose.

4. Acceptable use

   You agree not to:

   • Use the Service to violate any law or regulation
   • Attempt to access any part of the Service that is not publicly available, including the operator console
   • Interfere with the Service's operation, security, or rate limits
   • Scrape, harvest, copy, redistribute, or commercially exploit the Service's content without prior written permission
   • Misrepresent the Service as offering investment advice, signals, or any licensed financial activity
   • Submit content through any form (waitlist, feedback, support) that is unlawful, misleading, abusive, or infringing

5. Intellectual property

   All content on the Service, including text, design, code, algorithm output presentation, charts, branding, and methodology, is the property of the operator and protected by applicable intellectual property laws. You may view content for personal, non-commercial use. You may not republish, redistribute, mirror, or commercially exploit content without prior written permission.

   The algorithm's underlying methodology and source code are not licensed for use. The track record and outputs are published as research material; you may reference them with attribution but may not present them as your own.

6. Third-party services

   The Service relies on third-party providers (hosting, database, email routing, CDN, privacy-friendly site analytics). The operator is not responsible for third-party service availability, performance, or data handling beyond what is described in our Privacy page.

7. No warranties

   The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

   The operator does not warrant that:

   • The Service will be uninterrupted, error-free, or secure
   • Algorithm outputs are accurate, complete, or fit for any purpose
   • The track record is exhaustive or free from technical errors
   • Information on the Service is current at any given moment

8. Limitation of liability

   To the maximum extent permitted by applicable law, the operator is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, business, or trading capital, arising out of or in connection with your access to or use of the Service, including but not limited to losses arising from any decision you make based on algorithm outputs or other content on the Service.

   Where applicable law does not permit full disclaimer, total liability for direct damages is limited to the amount you have paid to use the Service in the preceding 12 months, which, for a free service, is zero.

   Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited by applicable law.

9. Beta status

   The Service is in active development. Features, content, algorithm behavior, and data may change without notice. The Service may be unavailable, incomplete, contain errors, or behave inconsistently. Use the Service with this understanding.

10. Termination

    The operator may suspend or discontinue the Service, or your access to it, at any time, for any reason, without notice and without liability.

    You may stop using the Service at any time.

11. Changes to these Terms

    The operator may update these Terms. The current version is identified by the effective date at top.

    For material changes, the operator will provide reasonable notice by a prominent notice on the Service or by email to addresses on file. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms, except where applicable law requires fresh consent.

12. Governing law and disputes

    These Terms are governed by the laws of the operator's place of residence, without regard to conflict of law rules. The operator's home jurisdiction will be confirmed in writing only when required by applicable law or a court of competent jurisdiction.

    Statutory consumer-protection rights under the laws of your country of residence are not affected by this clause. EU, UK, and California residents retain their mandatory consumer rights and may bring claims in their local courts where applicable law so provides.
